    What is Personal Information?

    How do we collect your Personal Information?

    We collect Personal Information from various sources, including:
    Information you provide to us.
    We collect most of this Personal Information directly from you. For example, when you contact Jooice directly or when you register or create an account on our Platform, which allows or requires you to provide certain information to us (e.g., contact information such as your name, email address, telephone number, etc.) or when you use our Platform. You provide Personal Information and other information to us when you contact us through our Platform.
    When you post content to our Platform.
    You may also be able to add, post or upload comments, social media content, or other materials, such as information related to your business, to our Platform on public areas of the Platform, or transmitted to other users of the Platform or to third parties (collectively, “User Contributions”). Your User Contributions are posted on and transmitted to others at your own risk. Although we may limit access to certain pages, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of other users of the Platform with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.
    Information we collect automatically as you use our Platform.
    As you navigate through and interact with our Platform, we may use automatic data collection technologies to collect certain Personal Information about your interaction with our Platform, the information we collect typically includes:
    • Details of your visit to our Platform, including browser type, operating system, traffic data, your IP address, and information regarding a consumer’s interaction with our Platform or advertisements;
    • Your physical location and movements. The types of location data we collect depend in part on your device and account settings.     As described more fully below, we use the Personal Information that we collect about you or that you provide to us for the following purposes:
    • Provide our Platform and related services to you.
    • Provide you with information or Services that you request or purchase from us in a conventional manner, through email or telephone number, or with the assistance of the AI-powered virtual assistant.
    • Process your requests, purchases, transactions, and payments and prevent transactional fraud.
    • Support, develop, troubleshoot, and debug our Platform and Services.
    • Create, maintain, customize, and secure your account with us.
    • Provide you with notices about your account, including subscription notices and reminders, and expiration and renewal notices.
    • Provide you with support for the Platform and to respond to your inquiries, including to investigate and address your concerns and monitor and improve our responses.
    • Personalize your Platform experience and to deliver content and product and service offerings relevant to your interests.
    • Administer surveys and questionnaires.
    • Provide you information about products and services, and other information that may be of interest to you, including through newsletters.
    • Authenticate use, detect fraudulent use, and otherwise maintain the security of our Platform.
    • Help maintain the safety, security, and integrity of our Platform and Services.
    • Internal testing, research, analysis, and product development, including to develop and improve our Platform, and to develop, improve, or demonstrate our Services.
    • Auditing relating to a current interaction with you and concurrent transactions, including, but not limited to, counting advertising impressions to unique visitors, verifying positioning and quality of ad impressions, and auditing compliance with any applicable specification and other standards.
    • Detecting security incidents, responding to, protecting against malicious, deceptive, fraudulent, or illegal activity, and prosecuting those responsible for that activity.
    • Debugging to identify and repair errors that impair existing intended functionality.
    • Carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.
    • To respond to law enforcement requests, court orders, and subpoenas and to carry out our legal and contractual obligations.
    • Notify you about changes to our Platform or any products or services we offer or provide though them.

    Provide our Platform and Related Services.
    We use your Personal Information to operate, maintain, supervise, administer, improve and enhance our Platform and related Services, features and functionality. We use your contact information to communicate and interact with you, such as to send you emails and text messages about our Platform. We use the IP address assigned to your device to send you the data you request to display on your device. We use unique identifiers stored in cookies on your device to help us authenticate you as the person who should have access to certain areas and features of our Platform. We also use your information to ensure our Platform is working as intended, such as tracking outages or troubleshooting issues that you report to us. And we use your information for research and development for our business, and to make improvements to our Platform.
    Analyze Use of the Platform.
    We use data collected from you and your devices for analytics and measurement to understand how our Platform is used. For example, we analyze data about your use of our Platform to accomplish tasks such as optimizing the designs of our Services. We use a variety of tools to do this, such as Google Analytics and similar third-party online data analytics services.
    Personal Information Provided by Third Parties.
    We may use Personal Information collected automatically and associate it with Personal Information we collect in other ways or receive from third parties. It helps us to improve our Platform and to deliver a better and more personalized service by enabling us to:

    • customize our Platform according to your individual interests;
    • speed up your searches; and
    • recognize you when you return to our Platform.
    Security and Legal Purposes.

    We may use your Personal Information to provide interest-based advertisements from us and that are customized to your particular preferences, including for companies that are not affiliated with us. See additional information under Why and How We Disclose Your Personal Information below for additional information about our sharing your Personal Information for personalized and interest-based advertising.
    Advertising and Marketing.
    We may also use your information to contact you about our Services that may be of interest to you. Please contact us using the Contact Information at the end of this Policy if you would like to opt out or change your preferences with respect to receiving advertising and marketing communications from us.
  • Why and How We Disclose Your Personal Information

    We share Personal Information with third parties under certain circumstances and for certain purposes described throughout this Policy, including:
    • Our business purposes. We may share your Personal Information with our vendors, service providers, and business partners, including providers and vendors we use for our business activities and operations generally, such as data hosting and data storage partners, analytics, ad network, advertising, technology services and support, and data security. We contractually require these third parties to keep Personal Information confidential and use it only for the purposes for which we disclose it to them. We may also share your Personal Information with professional advisors, such as auditors, law firms, and accounting firms. We contractually require these third parties to keep Personal Information confidential and use it only for the purposes for which we disclose it to them.
    • Service providers and others to operate our Platform and Services. We share your Personal Information with our affiliates, vendors, service providers, and business partners, including those we use for operating and maintaining our Platform, and its features, functionality and Services. For example, our website includes a chat bot feature. By using the chat bot, you acknowledge and consent to the information you provide may be shared with our third-party chatbot provider, who may use this data to train and improve their models.
    • Compliance with law. We may share your Personal Information to comply with applicable law or any obligations thereunder, including cooperation with law enforcement, judicial orders, subpoenas, and regulatory inquiries.
    • To Enforce our Rights. We may share your Personal Information to enforce our Terms of Use and any other agreement, terms and conditions relating to your use of the Platform. We also may share information as needed to ensure the safety and security of our Platform and our users, and to detect, prevent, or otherwise address fraud, security, or technical issues.
    • Protect Rights, Property and Safety. If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Jooice, our customers, or others. This may include exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.
    • Business transfers. We may share your Personal Information to a buyer, potential buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of a bankruptcy, liquidation, or similar proceeding, in which Personal Information held by us about our users are among the assets transferred.
    • De-identified information. We may also share de-identified information, so that it cannot be reasonably used to identify any individual, with third parties for marketing, advertising, research, or similar purposes.
    • Knowledge and Consent. With your consent, pursuant to your instructions, to fulfill a purpose for which you provide the information to us, and for any other purpose disclosed by us when you provide the information.
  • Your Choices for How We Collect, Use and Share Your Personal Information

    You may send us an email at support@jooice.com or visit our online form to request access to, correct or delete any Personal Information that we have collected about you. We cannot delete your Personal Information except by also deleting your user account. We may not accommodate a request to change or delete your Personal Information if we believe the change or deletion would violate any law or legal requirement or cause the information to be incorrect.

    We provide you with various choices on how you can opt out of our certain uses and sharing of your Personal Information. As a general rule, you cannot opt out of our collection, use and sharing of Personal Information to the extent it is necessary to provide the Platform or related basic services, features and functionality available on or through the Platform to you.
    Personalized and interest-based advertising.
    You can generally opt out of receiving personalized and interest-based advertisements from third-party advertisers and ad networks who are members of the Network Advertising Initiative (NAI) or who follow the Digital Advertising Alliance’s Self-Regulatory Principles for Online Behavioral Advertising by visiting the opt out pages on the NAI website and DAA website. We do not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of third parties collecting your Personal Information for targeted advertising purposes in the United States by visiting the National Advertising Initiative's (NAI) opt-out page and the Digital Advertising Alliance's (DAA) opt-out page.
    Cookies.
    You can change the cookie settings that will be placed when you use our Platform by changing the settings on your Internet browser. You can also block cookies by activating the setting on your browser that allows you to refuse the setting of all or some cookies. Please note that internet browsers allow you to change your cookie settings. These settings are usually found in the 'options' or 'preferences' menu of your internet browser. However, if you use your browser settings to block all cookies (including strictly necessary cookies), you may not be able to access or use all or areas and aspects of our Platform.

    Messages.
    If you do not wish to have your email address used by Jooice to send you advertising messages and content, you can opt out at any time by clicking the unsubscribe link at the bottom of any marketing emails you receive from us. You may have other options with respect to marketing and communication preferences through our Platform.
    Do Not Track Signals.
    We also may use automated data collection technologies to collect information about your online activities over time and across third-party websites or other online services (behavioral tracking). Some web browsers permit you to broadcast a signal to websites and online services indicating a preference that they “do not track” your online activities. At this time, we do not honor such signals and we do not modify what information we collect or how we use that information based upon whether such a signal is broadcast or received by us.
  • Accessing, Correcting and Deleting Personal Information

    Access, Corrections and Deletion.
    Please contact us using the Contact Information at the end of this Policy if you have any questions regarding reviewing, accessing, correcting or deleting your Personal Information. Please promptly inform us of any changes or errors in any Personal Information we have about you to ensure that it is complete, accurate, and as current as possible. You may also have certain deletion rights in accordance with applicable law. We may not be able to accommodate your request if we believe it would violate any law or legal requirement or cause the information to be incorrect.
    User Contributions.
    If you delete your User Contributions from the Platform, copies of your User Contributions may remain viewable in cached and archived pages, or might have been copied or stored by other Platform users. Proper access and use of information provided on the Platform, including User Contributions, is governed by our Terms of Use.
  • Children’s Privacy

    Our Platform is not intended for children under 18 years of age. No one under age 18 may provide us with any Personal Information on or through the Platform. We do not knowingly collect Personal Information from children under 18. If you are under 18, do not use or provide any information on our Platform or on or through any of its features, register on the Platform, make any purchases through the Platform, use any of the interactive or public comment features of our Platform or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received Personal Information from a child under 18 without verification of parental consent, we will delete that information. If you believe we might have any information directly from a child under 18, please contact us using the Contact Information at the end of this Policy.
  • Jurisdiction-Specific Privacy Rights

    The law in some jurisdictions may provide you with additional rights regarding our use of Personal Information based on applicable state law, e.g., for Texas residents, the Texas Data Privacy and Security Act (“TDPSA”). Other states have passed consumer privacy laws that may be applicable to Jooice and your use of the Platform. These supplemental disclosures and rights apply to you and your use of our Platform to the extent applicable state law applies to Jooice and your use of our Platform.     Personal information does not include information that is excluded from the scope of the TDPSA, like: (a) publicly available information from government records; (b) de-identified or aggregated consumer information; or (c) certain information excluded from the scope of applicable state law (e.g., PHI covered under HIPAA and medical information may be covered under HIPAA and other state laws).
    Categories of Sources From Which We Have Collected Personal Information
    As described in more detail in this Privacy Policy, see How do we collect your Personal Information, we collect Personal Information directly from you, for example when you provide it to us, when you contact us through our Platform; and indirectly from you automatically through your computer or device as you use our Platform. We may also collect Personal Information about you from third-parties such as our advertising partners and service providers.
    Purposes for Our Collection of Your Personal Information
    We limit the collection, use, retention, and sharing of Personal Information to that which is reasonably necessary and proportionate to achieve the business purpose for which the Personal Information was collected or processed (for more information, please see Why And How We Use Your Personal Information.

    We will not process personal information for purposes that are neither reasonably necessary to nor compatible with the purposes for which the personal information is processed as described in the Privacy Policy without your consent.
    Disclosure of Personal Information
    Jooice may disclose your Personal Information to a third party for one or more business purposes. When we disclose Personal Information for a business purpose, such as to service providers, we enter a contract that describes the purpose and requires the recipient to both keep that Personal Information confidential and not use it for any purpose except performing the contract.
    The TDPSA defines the sale of personal information as the “sharing, disclosing, or transferring of personal information for monetary or other valuable consideration by the controller to a third party.” Although we do not monetize your personal information, we may disclose the following categories of personal information:
    • Information that identifies, relates to, describes, or is capable of being associated with a particular individual
    • Internet or other electronic network activity information
    • Geolocation data.
    to the following categories of third parties:
    • Service Providers,
    • business partners;
    • data analytics providers;
    • advertisers and advertising networks;
    • social media companies; and
    • PSP (Payment Service providers)
    for purposes of marketing and advertising; analytics, measurement and improvement; and customization and personalization, which could be deemed to be a sale of personal information under the TDPSA. You may opt-out of certain sales as described below.
    Consumer Rights
    The TDPSA and other state laws provide residents with specific rights regarding their personal information. This section describes your rights and explains how to exercise those rights. For more information on how you or your Authorized Agent can exercise your rights, please see Exercising Your Consumer Rights.
    • Confirmation and Access. You have the right to confirm whether we process your personal information and to request access to that personal information we have collected and maintain about you except that we will not confirm or provide personal information that we believe would disclose our trade secrets. You may exercise this right as described below.
    • Correction. You have the right to correct any inaccuracies in your personal information processed by us, taking into account the nature of the personal information and the purposes of the processing of your personal information. We may also not be able to accommodate your request to change the personal information if we believe it would violate any law or legal requirement or cause the personal information or the information associated with the personal information to be incorrect.
    • Deletion. You have the right to request that we delete all of your personal information. We cannot delete your personal information except by also deleting your user account, however we may not accommodate a request to erase your personal information if we believe the deletion would violate any law or legal requirement or cause any information associated with the personal information to be incorrect.
    • Portability. To the extent we maintain your personal information in a digital format, you have the right to request that we provide you a copy of, or access to, all or part of such personal information in a portable, and to the extent technically feasible, readily usable format that allows you to transmit the personal information to another controller without hindrance.
    • Right to Opt-Out of Certain Processing. To the extent applicable, you have the right to opt-out of processing your personal information for the purposes of: (i) targeted advertising; (ii) the sale of your personal information; or (iii) profiling in furtherance of a decision that produces a legal or similarly significant effect concerning the consumer. This would include a decision that results in the provision or denial of health care services.     • Non-Discrimination. We will not discriminate against you for exercising any of your consumer rights. Unless permitted by applicable law, we will not: (a) deny you goods or services; (b) charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties; (c) provide you a different level or quality of goods or services.
    Authorized Agents
    You may authorize your agent to exercise your rights under the applicable state privacy laws described above. We may request that your Authorized Agent submit proof of identity and that they have been authorized to exercise your rights on your behalf. We may deny a request from your Authorized Agent to exercise your rights on your behalf if they fail to submit adequate proof of identity or adequate proof that they have the authority to exercise your rights.
    Response Timing and Format
    We will generally process Consumer Requests within 45 days of its receipt. If we require more time (up to 45 additional days), we will inform you of the reason and extension period by email. If we cannot comply with your request, we will provide you with an explanation of the reasons we cannot comply with a request.

    We do not charge a fee to process or respond to your Consumer Request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
    Appeals Process
    You may appeal a refusal by us to take action on your request to exercise any of the above rights within a reasonable period of time after we provide you notice of such refusal by contacting us through the contact information listed below.

    Within 60 days after we receive your appeal, we will inform you in writing of any action taken or not taken in response to your appeal, including any explanations for the reasons for the decision. If we require more time, and if an extension is permitted under your state law, we will inform you of the reason and extension period in writing.     Personal Information provided in response to a request to exercise these rights may be provided free of charge twice per Texas resident annually.

Ai sensi dell’art. 13 del Regolamento UE/2016/679 (di seguito “GDPR”) e del D.Lgs. 196/2003, cosìcome adeguato dal D.Lgs. 101/2018 (di seguito complessivamente “Normativa”), WebidooS.p.A. fornisce le informazioni sul trattamento dei dati personali.
  • Titolare del trattamento

    Titolare del trattamento è la società Webidoo S.p.A., con sede legale in Milano, Via Gioberti, 8 (diseguito “Titolare”) la quale raccoglierà e tratterà i dati personali da te forniti nel presente sito pertrattarli per le finalità indicate di seguito.

  • Finalità e basi giuridiche del trattamento dei tuoi dati personali

    Tratteremo i tuoi dati personali per le seguenti finalità:

    • erogare i servizi forniti mediante l’utilizzo dell’intelligenza artificiale e rispondere alle richieste dell’utente. Base giuridica di tale trattamento è la necessità di dare esecuzione ad una richiesta dell’utente, dare esecuzione ad un contratto e/o a misure precontrattuali adottate su richiesta della persona cui si riferiscono i dati. Per questa finalità il conferimento dei dati personali è necessario, pertanto, il loro mancato conferimento comporterà l’impossibilità per l’Utente di ottenere i servizi richiesti al Titolare;

    • inviare comunicazioni promozionali su prodotti e servizi del Titolare attraverso strumenti automatizzati (banner, email, sms, mms) e non automatizzati (posta cartacea, telefono con operatore). Base giuridica è il consenso dell’interessato. L’utente in qualunque momento potrà revocare il consenso prestato all’invio di tali comunicazioni, ferma restando la liceità del trattamento effettuato sulla base del consenso precedentemente prestato;

    • individuare e definire i gusti, le preferenze, le abitudini, i bisogni (c.d. “profilazione”). Base giuridica di tale trattamento è il consenso dell’interessato. L’utente in qualunque momento potrà revocare il consenso prestato all’invio di tali comunicazioni, ferma restando la liceità del trattamento effettuato sulla base del consenso precedentemente prestato;

    • gestire ed elaborare report statistici aggregati sull’utilizzo della piattaforma da parte degli utenti e, ove necessario, esercitare i nostri diritti di azione e difesa in giudizio. Base giuridica di tale trattamento è il legittimo interesse del titolare;per finalità di customer Satisfiction, potrebbero essere inviati questionari agli utenti che saranno analizzati tramite report statistici in forma aggregata. Base giuridica di tale trattamento è il legittimo interesse del titolare;

    • per adempiere a qualsiasi altro obbligo derivante dalla normativa applicabile o da un ordine dell’autorità. Base giuridica del trattamento si rinviene nell’obbligo legale a cui è soggetto il titolare del trattamento.

    I dati trattati dal Titolare sono costituiti da:

    Dati di navigazione

In particolare, i tuoi dati personali saranno conservati per il tempo strettamente necessario al perseguimento delle finalità per cui sono stati raccolti, salvo l’ulteriore periodo di conservazione previsto dalla legge.
  • Sicurezza del trattamento

    In quanto Titolare del trattamento dei dati personali, Webidoo garantisce elevati standard di sicurezza in relazione al trattamento degli stessi, mediante l’utilizzo di strumenti idonei ad assicurare la riservatezza. I dati sono trattati dal Titolare con modalità, strumenti e procedure informatiche e telematiche strettamente necessarie per realizzare le finalità descritte al punto n. 2 della presente informativa.

    Webidoo predispone misure di sicurezza fisiche, tecniche, e organizzative ai sensi dell’art. 32 GDPR per prevenire la perdita dei dati, usi illeciti o non corretti e accessi non autorizzati (Data Breach).
  • Diritti dell’interessato

    Nel pieno rispetto degli articoli da 15 a 22 del GDPR, in qualsiasi momento può essere chiesto di conoscere quali sono i dati personali oggetto di trattamento. In particolare, è garantito il diritto di accesso, rettifica, cancellazione nonché, ove applicabili, il diritto alla portabilità dei dati, il diritto di limitazione del trattamento e il diritto ad opporsi al trattamento.
